1.) I have never heard of an Ag Assault with a Weapon that did not result in injury.

2.) The victim's desires will have only a limited impact. Having a baby with him makes it a Domestic Assault, and those get prosecuted even without the cooperation of the victim.

If he gets certified as an adult, it could be 5-10 years.

It really depends. The judge has a wide latitude. The Crown (or prosecutor in the US) will suggest sentences they think is reasonable - in my area, domestic assault always results in a recognizance or undertaking not to contact the victim, usually for 12 months. The minor's attorney or legal agent can try and petition for leniency based on age, behaviour, etcetera.

If your area is like mine, though, as a minor, he'll probably end up in either some counseling program or at one of those holistic-feel-good counseling-and-imprisonment houses.

Edit: For Citicop, I got an aggravated assault with a weapon that caused no injury. Local PD charged him for throwing a coffee cup full of cold tea - the coffee cup was considered a weapon. The guy was stupid, but I thought it was a bit of a stretch.

Depends on which state he lives in. In Tennessee he would probably be charged as an adult. And it wouldn't matter what the victim thought about it. In cases of violent crime the state does the prosecuting and the victim has no say so in the matter.

My question is 15 and has or is having a baby?? I think in this case it's for the best to spend as much time as possible and get this CHILD out of the hands of his parents who obviously didn't care enough to teach this child right from wrong.

The victim needs to wake up and leave this man well enough alone. No second chances. Think about your baby's safety.
