Yes, it is a discriminating organization. The BSA requires its members to adhere to the Oath and Law, and to the guidelines established by the organization.

The BSA will also refuse entry to skinheads, persistent drug users, and anyone it feels will harm the members in any way.

No, as a private organization they have the right. This is still the USA.
