My boss is a penny pinching clueless fool who is too tight to employ a cleaner.
His most recent idea is that the staff must clean our communal common room- IN OUR OWN TIME! (not in work time)

It is a large room and it would take over half an hour.
He has said that whoever does not will not be able to use the room.
Surely he cannot lawfully ask us to work for free, and then punish us if we don't agree???
Anyone?

no he cannot do this! anytime at work is covered by regulations, so if you do this in your own time at his request its overtime and he must pay you HOWEVER he can say you are responsable for cleaning the room but this must be on work time or specified in your contract

Although he cant stop you from using it or make you clean it (thats the law) He dosent have to employ a cleaner you lot made the mess so why should'nt you clean it up?
I'm not trying to diss your question but is he your mother?
I work maintainence in the office block of a major bank and they think its ok to wipe (for the lack of a better word) boogies on the toilet walls, this is in the ladies as well as the gents! so tell me who should clean that $h1t up??

Call the local Government Labor Board. They'll have guidelines.
But, even though it's crass and draconian, it is his property and he has a right to ban the use of a room subject to terms. That's not "punishment" per say.
I'd eat outside or at your desk....remove yourself from the fray.
Get another job. This guy is psycho.

He is a miser isn't he.
But no he can't have you doing it in you own time for FREE. It is classed as over time if you do it after hours. I am not sure whether he can insist on you cleaning though. Does your employer have a regulations book, or do you have a contract, what does the book or contract say?

Cleaning a break room at his business would be considered work under every state law I have read and as such he must pay you for the hours you work unless you are a salaried employee.

If your on salary there is nothing you can do, but if your an hourly employee then you must clock in and out for all hours worked and this would include what you described.

you can file and claim again the business with the wage and hour board for your state..

File a grievance with the labor board and no he can't make you do any work on your own time. If you get punished for it see a shrink, cry a lot and make him pay through a nice little lawsuit. ahh the American dream

He can't do that, apart from it being in your own time, it's not in your job description! If he persists in being an obnoxious di**head, I would take your workmates and all have a chat with the people at Citizens Advice.
