I am renting the upstairs of a house (apartment #2). The downstairs is Apartment #1. We have one mailbox outside with NO name, just house number. When I go to get mail, the neighbors mail is in there. When I ask her to give us a separate one, she doesn't listen to me, talks about something else like how high her bills are.

First of all, I assume that the downstairs resident is the landlord. It is quite possible the the apartment you are renting is not legal, either due to zoning or being built without a permit. The landlord does not want a second mailbox because she does not want to call attention to the apartment!

If this is the case, you should talk to the landlord, and explain to her that you do not want to share a mailbox. If she is unwilling to put a separate box up for you, she should pay for the cost of a post office box for you to get you mail privately!

Be aware that if the local government finds out about an illegal apartment, you can end up being put out on the street when they shut it down, even if you have a lease.

I say go and get another mailbox for yourself. Put it beside the other one and mark your apartment number on it. Tell the post office what you are doing so that they can start sorting the mail. You don't need to ask the downstairs person anything! In my opinion she only wants an excuse to snoop into what mail you are getting. Besides, you deserve to get your own mail in your own mailbox because you don't share her house or apartment, why should you share the mailbox. I actually did this once in a place I lived. I even put my last name on the mailbox. You are entitled to a little privacy you know.

It's legal. The PO delivers to whatever boxes are available. What you want to do is put your own box up and label it Apt. #2. Then put in a permanent change of address to the PO with your old address then the new address listed as same as old, Apt. 2.
