my friend has just been charged with sexuall abuse by his step kids, there stating he did it 30 years ago, i know he did not do it but what are the laws on it, they have made those claims because there mum died 5 years ago and she left him the house, and they want him to sell the house and give them half the money, but he would not and they said they would get him another way, what are the laws.

live in england and no i was not with him 24/7 but i know him well anough plus there mother was the most amazing women in the world and would never of let anything like that happen and they would of told her cos they had that sory of relationship.

I'm sure it depends on the state. Depending on the statute of limitations per that state.

I'm sure under a investigation they would find that the kids were unhappy with the arrangements. The state would probably charge them with false police reporting. But how far it goes would be up to the state. I'm sure they would have to provide some sort of evidence for coming forward 30 years later and only if it is admissible

It's very sad when people stoop to telling lies of that level. One thing that you may suggest is for the accused to take a lie detector test. If the results confirm that he is indeed telling the truth, he should turn around and sue them for deflammation of character. No, two wrongs don't make a right, but when you are dealing with a situation like this sometimes you have to do what you got to do. I would suggest that you go online and find out what the laws are for the state that you live in.

Sorry mate, but having read your additional comment I think that you are incredibly naive. Sexual abuse happens in the most outwardly loving families all the time across the world; the best mother in the world with the best relationship with her children wouldn't necessarily become aware of the abuse and even if she did then there are many reasons why she wouldn't necessarily act on it.

The best thing you could do is tell your mate that you're not going to judge him but that if there's the slightest bit of truth in the allegation then he's only doing more harm.

They have to prove his guilt not the other way round.Nice to know you were with him every second of the day 30 years ago you'll make a great witness but if he did do what he is accused of i hope he get's what's coming

I believe there was a statute of limitations at that time, I can see the motive for faulse incrimination so they better be careful he can sue them for faulse incrimination.

An attorney is your best bet, as these are laws that are changing in some places.
