Of course you have to tell the government if you are getting divorced. You also have to tell them that your wife and child are no longer in govt quarters. As long as you are married your WIFE is entitled to BAH(you better make sure she gets it or she can go to your chain of command and cause plenty of problems for you). You can not maintain quarters w/o your wife or son w/ you. Do the right thing. Don't be a thief or you will regret it.

U have to tell the government that u are separated. If u end up gettin the divorce u have to tell them. Be honest. If u don't tell them and they find out u might have to pay all that money back that they gave u for being married. Ur in the military u should know this stuff more than me. I'm not in the military but it's just common sense.

The answer:
As long as you are married, you get the benefits.
Once the divorce is filed, you lose the benefits. If you continue to pretend you are married, and the military finds out (and they will), you will be sent to court martial, and punished...first by paying back the money you "stole", then they will take a rank or two, and probably confinement to seal the deal.
Sorry your wife left you...but you still gotta do the right thing.

D-U-H...You want to be court martialed for taking money under false pretenses? Not only would you lose the 800, but also everything else. They may be obligated to pay you through the date the judge divorces you...but you should start whatever paperwork is needed with the military. BTW, they'll know eventually, because the service will get the child support order to process, and it will be automatically taken out of your pay.

Are you trying to say that you are living in Post Quarters and drawing housing allotments?
Sorry but its either or, no way is it legal to do both at the same time.
And even if this were true and you were doing this you want to know if you should cheat the taxpayer out of money because you want it when you aren't due it?
Give me your Unit so I can talk with your commander about the ethics of the troops in his command.

Your wife moving out is not "being divorced".
You may still be eligible for the BAQ and separate rations depending on what happens with the custody of your son.
You can get free legal advice from your JAG office or talk to your First Sergeant.
