My husband is in US Navy boot camp.. He's been there a month and we still have not recieved his first paycheck. (pay day= 1st & 15th)The recruiters said AFTER he left that I probably won't get the check until the 15h of this month.. My rent's due tomorrow. I'm in college, and working part time, i have NO money to pay rent.
I went in and talked to my apt. manager today and explained the situation, and she said they still have to issue us an eviction notice on the 8th, and our paying rent late will go on our record. And we are also getting a late fee, (which is normal when you pay it late..) And if I don't pay it before the 20th of this month, ill be getting evicted.

Is there any kind of law or ANYTHING that can prevent us getting evicted, because he's in the away in military? Its just sooo unfair because they take FOREVERRR to issue pay I guess! I can't even talk to him either, only through letters. Its so frusterating. If you know anything, it would help a ton. Thank you so much!

It takes 6-8 weeks to get that first check.

I was in the same boat when my husband went to Basic training. Go to your base's Family Support Center. See a counselor and tell them what is going on (he's in Boot camp, no money, the eviction paperwork). they will contact your apartment complex and tell that what is going on. They will also request that you be charged no late fees dueto him being in boot camp. Most apartment complexes comply when family support asks. You will NOT be evicted. Family Support will make sure of that.

Our old apratment complex gave me the same crap when my hubby was away. I went to family support, they called the apartment, I was charged no late fees and was able to pay when my husband's check came in 8 weeks later.

Not sure how the Navy works , but you CAN get your husband a red cross message, if the Recruiter isnt helping you..
There is no Law while he is in Basic that prevents legal action .. I know this doesnt help but they can not kick you out over night, I had a pay problem while i was in BCT instead of getting paid on the 1st of July the Army National Guard paid us on the 7th our Drill SGT called everyone i nthe Guard into the office and let us call home .
I suggest if the Recruiter wont help you call the Red cross and get him a Message. With the Army we have AER (Army Emergency Relief ) where he can take an emergency loan out to help pay for food , rent other utility bills, you could try Navy-Marine Corps Relief Society Auxiliary that is the Navy's version , if your husband gave you POA you need that your Military id and proof you have not paid the rent ie eviction notice.. though you have to repay the loan back it is interest free.

Well I'm not familiar with any other state laws but in texas theres no law that allows you to not pay your rent because you have no money, regardless of the circumstances. Your best bet I would say is to let them know why and tell them when you can expect the payment, they SHOULD appreciate your honesty and respect and allow you to stay until you have the money for the people that collect your rent. If this isn't your first time being late on your rent they might not be so leniant towards your situation. Never the less you signed a contract and you agreed to pay the rent on the X day of every month I assume and thats what the law will expect you to do. ALSO: An eviction notice is just to cover their butt's so they can get you out sooner if you don't follow through with your word.

Don't worry . . . if the check is coming on the 15th they probably won't evict you. However, they will start the process to protect themselves legally. Pay the rent and late fee when you get the check . . . eviction is a legal process and takes a lot longer than two weeks.

They have to start the process . . . failure to do so would be a verbal addition to the lease. Landlord in Florida.

Hard to believe that only after one payment they will be evicting you most places are usually willing to work out something.
Do you have anyone in your family or friends that can give you a loan so you don't have to pay late fees.
As sad as it is you should have known that you wouldn't get paid right away and should have made prior arrangements.
You might want to check out www.militaryonesource.com and see if they can help or suggest anything else.
You might also want to look up your state laws regarding eviction.

Look up the Soliders and Sailors Relief Act, there are provisions in there about evictions while a service member is away. It also protects the family in come cases. You can always go to Finance and talk to them. The military is not going to let you suffer. There are so many ways to get emergency funding for situations like this you just have to get out there and look. So, start with the Relief Act, go to the base and talk to someone in Finance and if you have to go to JAG. Don't get discouraged and good luck!

I'm sorry, I don't know any laws that can help you but, the first 2 paychecks go towards him buying the uniforms that he was issued. So, if he's been in there a month, You should see a paycheck on the 15th. I'm sorry about your situation. Wish I could help more.

Contact the Navy-Marine Corps Relief Society. They give loans to Navy families with financial emergencies. I don't think they charge interest, either. Hopefully they can help:

it takes a long time to evict someone, months at least, by then you'll have the money. and i dont think rent payments go on a credit report so you tell her shell get her money when youre good and ready

It doesn't seem like you will be that late with your rent. Just tell your landlord that you will pay the late fee and you should be fine.
