yah you betcha they can and they are being deported. many different states local law enforcement are being trained to assist ICE. often times they are detained at the time of contact with law enforcement. look at the attachments for verification. EDIT i read the news every day. read the articles on the links. check the dates i search for the most current information. most everyone else who has posted has outdated information offer nothing to support it. i tried to attach all the info i could find from different cities and states. all are either checking citizenship status or are in the process of learning what is necessary so they can check citizenship status. this would be local police or jails.

a lot of the time if it is something minor like the things you described, the court systems dont even take the time to verify if they actually are illegal or not. It is so common for people to make fraudulent visa's, green cards and other licenses that take a some work to verify if they are legitimate or not -- but if they are minor incidences, as long as they have something to show for ID, they will not double check that it is valid and legal unless more charges are filed against the person -- IE, if someone goes in for a speeding ticket, they go to court, they have the chance to contest if they choose -- they get another court date. If they plead guilty or are found guilty on their contest date, they will be fined and asked to pay......if they have the money to pay upfront right there, well then there ya go, problem solved, they're not going to worry themselves at that point wether or not their papers are legit because the problem at hand as already been solved. If they do not have the money to pay then and there, you get assigned a probation officer to pay off the ticket on a monthly basis to the probate office -- now if they happen to skip out on their probation meeting THEN it because a highly suspicious situation and they may look into it, because even though a traffic ticket is NOTHING, skipping out on probation is a serious offence, no matter how petty the reason you got put on probation is, and will include yet another court date and possibly jail for skippin probation -- at which point they will look into the legitimacy of thier paper work, and they could possibly get deported if illegal --- though by some weird loopholes, not EVERYONE who is caught as illegal is actually deported. Don't ask me why, I dont get it, all i know is that there are some loopholes in the deportation laws and not all who are illegal actually get deported, even if caught --- i guess it's just one of those "depends on the circumstances" type orders.

depending if they're using fake documents to prove that they have permission to be in this country for work, etc.....
they wont be suspected also unless the immigrant has several fake documents or aliases AND if they have been in trouble in other states that they've ran away from. I've seen people get deported from court. They actually have to serve the time here, and then get deported immediately. sometimes not even directly to their country! they just leave them anywhere close to border as long as they're not in!

because of overcrowding in federal immigration detention centers, they only put the worst offenders into deportation proceedings. Often, many offenders are just released and asked to show up later at a court date to discuss their immigration status. Many don't show up.
State and local governments often don't check immigration status during crimes or arrests. That's why there's the current flack about "santuary cities" in the presidential campaigns. many police departments make it a point not to ask for immigration paperwork, etc. They don't consider it their problem and might make illegal immigrants afraid to report crimes.
The few states and municipalities that have started checking have been targeted by advocacy groups and costly civil liberty law suits. Often, that's enough to make them back down.
Furthermore, because of the right of all people in the U.S. to have due process in court, deportation isn't as quick as one might think. If the governement DOES start deportation proceedings against an immigrant, that immigrant has a right to exhaust his/her appeals process -- which can take years. And, often, the immigrant with have a court throw out the deportation during the appeals process.
Depressing, huh? That explains a good part of why our immigration system is so ineffective.
