& what could happen if i don't charge it when i should have?

You should only charge tax if you have a tax license and only if the sale is within the state for which you have the license.

Well, if you run a store and pay taxes perhaps you should charge it. Still lots of eBay store don't charge you a sales tax. Or some charge you only if you're in their state or province.

If you sell to somebody in your state, you should be charging sales tax. If the buyer is out of state, you don't.

You are the one who actually owes the sales tax to the state. So if you didn't collect it, then you owe it personally to the state.
