Okay so some byb set up their "puppy stand" outside of our local pet store every weekend (the same times our rescue does an adoption)
They are APRI registered hahaha!!!
anyway,
we live in texas and we were told it may be illegal for them to set up in a public parking lot and sell animals.
Also the puppies are only 6 weeks old...is this illegal.?
our aco does not care, and does not want to do the work.
The petstore parkign lot is community parking lot..so the sotre manager said that even if they are right in front of the store on the sidewalk he cannot say anything.
any advice on how to get these people to stop selling their 1500 2 pound yorkies? (mini greyhounds, teacup chis, chug, pugs...and the list goes on...)

if people do it at a local petco or petsmart they ar most likely a rescue or shelter.

I also live in Texas and have also heard that selling dogs in a parking lot is illegal. As for selling the pups at 6 weeks old, unfortunately, I don't believe that is illegal, just a bad choice. I would contact the police because as I said, I do believe that is illegal in the state of Texas.
ADD: Ha! That's funny that you put that banner up! They were probably so mad.

By federal law it's illegal to sell puppies under 8 weeks of age. You can report it to A.C. or ASPCA or which ever agency regulates pets and pet ownership in your area. If the puppies are in poor condition, are not treated properly while out there or seem ill you can report that as well. Try to get their names, "kennel" names and maybe go undercover with a camera. If their living conditions are horrible at the facility where they are being bred that's a good case for abuse/neglect. The more supporting evidence you have the easier it is to get something done about it. Good luck.

add: I may be a little off on the age limit I'm double checking.

add: Ok, not sure where I found it the first time, can't find it again so don't take that as solid gold. Contact animal control/spca and ask them Tell them everything you know about the situation and ask them, at least then you tried whether it's legal or not. If I miraculously find the site again I'll post the link.

First off if it is outside the store and on the sidewalk I would be contacting the city to see if a business license was needed. Then I would contact the Animal Control to report the selling of puppies too young. Keep calling and maybe someone will do something!

As for the parking lot to be a community parking lot I doubt that. I think the pet store manager just doesn't want the confrontation. I bet if you contacted the person who owns the land the packing lot is built on they would not be to happy about someone selling something out of their trunk. Unless of course this is common practice at the parking lot. I would contact the owner of the lot and the police to find out if it is in fact legal. Another option would be to make big signs with pictures detailing the brutal reality of back yard breeders. Have information to hand out to people why it is important to rescue and not support the byd. Lastly when they say I want a dog with papers politely tell them that the only thing those papers are really good for is to potty train your dog to pee on paper in the house.

First of all... somebody owns the parking lot and that would be whomever owns the Mal or the land. If the city owns the land or an individual owns the land...

I am with you... something is being violated... SO

I am sure some type of a "peddlers" license needs to be purchased..
THAT could be the loop hole you are looking for.
PLUS most states/counties have a minimum age for separation of pup and mother. Check it out by call ing your local States Attorneys office and let them do the rest.

The store manager may not realize that although the parking lot is considered public, it is owned by someone and therefore is NOT public. Anything which happens on that land is the landlord's responsiblity.

However, First off you should contact the local Animal Control to be sure of the laws and then take the next step as needed to the owner of the parking lot.

It doesn't matter if they are "pawning" puppies or cds or books or trying to have a yard sale. They can do whatever they want in *their* yard, but they cannot in a public (community) parking lot or street or anything (unless they have a vendor's permit, like someone in a craft fair or art fair would, or a special permit like at a community flea market)

Next time they do it, call your local buddies in blue and ask them if they might kindly inform these bozos of the laws regarding peddling one's "wares."

well yeah there not a licensed facility and plus selling pups on the side what the hell is going on there those dogs are not nearly well enough to be sold yeah thats illegal. Call the SPCA and file a report they will be glad you did. All you have to do is file a report with them saying what you saw. Yore a witness to an animal crime please do something. Its not acceptable anywhere reguardless of what that store manager said hes just covering his *** so he dosent get in trouble.

Wow, that's a tough one. Depending on your state, it may or may NOT be illegal. Call the sheriff's department, and ask your rights and theres, and see if you can do anything about it. Selling your dog at 6 weeks isn't illegal, I bet it isn't illegal at 2 weeks. It's horrible. I'd never take a dog before 8 weeks, and I'm even uncomfortable with 8, I prefer 10.

That's like a freaking mini puppy mill! How awful!

If I were there, I'd walk up to them and smack their faces.

I think that is illegal. In my state, puppies can't legally be sold earlier than 7 weeks. Check your state laws. Also, I know that in some states it is illegal to sell things in the parking lot. I have heard of people getting kicked out of parking lots before. Just call the cops and complain.
