at work this evening, i smelled paraphanelia coming from a guests room. Under our policy at work, unless a guest is actually burning down the room we cannot enter said room. Do such laws exist outside of work laws, (hypotheticly - citizens arrest, etc) that would allow a search of the guests room?

To increase the accuracy of Drew's response, paraphenalia is the word used to indicate the EQUIPMENT one would use in consuming a controlled substance.

Bongs, hookas, pipes, tubes, needles, syringes, are all examples of paraphenalia.

Contraband is the stuff that one would use in paraphenalia.

If you can smell it, it is neither contraband nor paraphenalia, but an indication of use.

That said, your hotel's policy is not actually a law. It is simply that if you want to keep on working, you will NOT be the one to bring such a minor violation of your local laws to anybody else's attention, because as long as nobody else cares enough to ring up the police, that guest might easily decide to come right back to that same hotel, instead of deciding that he needed to provide revenue to some other form of accommodation next time.

In most cases, an indication of contraband usage like smelling the smoke, is not enough to effect a citizen's arrest, but if the door were opened and there were a lit joint, that could be. But, if you want to keep your job, you will not effect that arrest, even if citizen's arrests are allowed in your jurisdiciton, because, your employer could fire you for that arrest by claiming that you were creating an unsafe environment by provoking drug dealers or something.

you smelled contaband not paraphanelia, paraphanelia is the device used to smoke the aforementioned substance. As for making a citizens arrest, why would you want to bother with all that drama. Who are you deputy dawg, just mind your Ps and Qs and leave the guests alone

Edit: Robert G, when is the last time you heard of someone smelling a syringe in a motel?

MARIJUANA IS LEGAL IN A SMALL AMOUNT IN SOME STATES AND VARIES FROM STATE TO STATE AS TO WHAT AMOUNT TO BE USED FOR PERSONAL USAGE? SO SOME PEOPLE LIKE IT BETTER THEN BOOZE OR CRACK? TO EACH THEIR OWN AND IF THEY ARE A PAYING CUSTOMER LET THEM HAVE A NICE MEL LO TIME.
