To tell somebody you want a gun to kill your friend, is not yet a crime committed by you but when that somebody you told offered you a gun for that purpose and then you execute the killing, you will be committing the crime of MURDER as principal. And the one who gave you the gun will be an accomplice. but as long as no killing occured yet you will not be liable for conspiracy. Conspiracy on a pre execution stage can only be a crime when such plans are intended to commit rebellion, sedition or any pre meditation for the purpose of overthrowing a government.

Should you then get a gun and kill your friend, the person you told (before the fact) is now an accessory after the fact because they knew and took no action to prevent the crime from occurring.

It's a conspiracy at this point and the friend is likewise a felon unless he immediately informs the police. Whoever the perp is you're talking about is really too stupid to be on the outside, anyway. Too bad our society is so filthy with scum like that around. Be good if they were all so stupid as to broadcast their projected crimes.

By even MENTIONING such a thing, most states COULD prosecute you for the 'inchoate' crime of conspiracy to commit homocide, even if it doesn't qualify as murder.
Even if you were totally joking, some humorless cop would have the authority to cuff and stuff you.
And, in my opinion, all cops should be that humorless.

Threats are taken very seriously. If you say that to someone, and he goes to the cops and repeats it, they can come after you. They have reasonable suspicion that you may commit a serious crime.
