I am a registered gun owner living in Texas. Now someone I know, a family member, wants to buy the gun. Can I just sell it to him or is there paperwork I need to do? If I sell it to him with the gun registered to my name would there be problems or issues if he is caught using the gun?

What do you mean ".....registered gun owner living in Texas..."? There is NO registration in Texas, for guns or owners, so what are you talking about?

If you mean you bought the gun legally....and filled out the background check document....that's for the background check only, it's not "registration".

If the person is over 18 (21 for handgun) and is not otherwise prohibited from owning a gun (felon, drug dependent, alien) you can just sell it to them. To protect yourself, write up a simple bill of sale with date, serial number, etc and have him sign it.

You DO NOT need a firearms dealer to transfer a firearm in Texas, and no background check is required.

My first suggestion is going to be blunt! Why ask people from all over the country (or the world) to answer a question for you that you can answer BEST by getting off your butt and going in to the local Wal-Mart in your area and seeing first hand and for yourself. We don't even know where you live so how can WE give you an honest and accurate answer about what YOUR Wal-Mart sells. You just got a BUNCH of answers and they each may be accurate in the answerer's neighborhood, but most of them are NOT accurate in mine. Here in Alaska, the Wal-Marts DO sell guns and have a large selection of just about any kind of sporting/hunting firearms that you would require INCLUDING handguns. They sell .17 and .22 small bore rifles, shotguns in all common gages, and high power rifles for ALL sizes of North American big game. They have a very good selection and I would have no problem finding anything I need including the ammunition to go with it. Our stores do NOT have a catalog and they do no special ordering. The guns are the same as those sold in any other outlet and are NOT some special cheap-o, less than perfect quality firearm made specifically for Wal-Mart to sell at discounted rates. You CAN buy from Wal-Mart knowing you are getting a quality firearm from its manufacturer with ALL the warranties available and guaranteed. And, NO, I do not work for Wal-Mart or have any connection with them other than as a repeat customer. However, I have managed the firearms and camping departments for two major sporting equipment dealers. I know what I see at Wal-Mart and I trust them to give me what I expect. You can too. Go do it.

The way you write the question almost makes one feel you have concern over the individual you are thinking of selling it to possibly getting in trouble and having the firearm.

If you do have concerns no matter the right legal answer you probably are going to continue to worry about it and it wouldn't be worth the concern.

If you have no reason to actually be concerned about the family member getting in trouble, then I would follow JD's advice. It is better to do things right once and not have to deal with it again. The BATF may say it is legal to transfer between individuals, but that won't mean a lot if the weapon is used in a crime and they ask how you assured yourself that the individual could legally obtain and own a firearm. In other words the burden of proof would be on you and they would make it tough on you if there is liability to be assigned.

So after all of that, yes you can probably just sell it to him, but the better answer would be to go through a dealer for the transfer just to CYA. (cover your posterior)

In most areas., private sales are perfectlly legal, just make sure the person you sell the gun to is eligible to have a firearm.

First of all there are no registered gun owners in Texas; but whatever. Just provide a bill of sale to the buyer and keep a copy for yourself. If you are over 21 and not a felon you have all the rights of a voting citizen and taxpayer. All hail the USA, still the home of the free.

For a long gun, you can just sell it to him. If you're worried he might use it in a way that could come back on you, get an FFL to run him first. For a pistol, you'll have to add it to his permit before you can sell it to him.
