No, you do not have a legal leg to stand on. If your car flipped and the front end did not hit the tree, the airbags won't deploy. Airbags only deploy when there is a front end collision. Very few cars have side impact air bags. Sounds to me like you are one of those person's that tries to find a reason to sue for your unfortunate misfortune.

Why should you sue? Did the airbags not deploying cause the crash? Were did you see any written that airbags would deploy in all crashes? As stated by others, most airbags are designed to deploy in frontal crashes. Whether they deploy or not there is never any guarantee that you won't be injured. Be glad that you can still ask this question online work with your insurance company on getting your car replace. Why does everyone think that suing is the answer to everything.

if the air bags deploy too easily the manufacturer gets sued.
if they dont deploy the manufacturer gets sued.
this is why a new car that used to cost 8 to 10 weeks pay now costs 25 to 30 weeks pay. no one benefits except the lawyers.

Why? Do you have airbags in the roof of your car? Air bags are of limited value in a roll over, and may even contribute to worsening injuries. They are meant to deploy in a frontal impact.

if you walked away, you should get your insurance check for the car and move along. If you're paralyzed, now that's another question. The people that get lawyers for air bags and safety belts not doing their jobs are doing so because they HAVE to because they are disabled or their heirs do because they were killed. they"re hard lawsuits to win because the car companies do a good job of making sure they work right.

air bags only deploy if the sensor is hit. If you car flipped end over end thay should have, if it rolled on it's side over and over the sensor would not have been hit.

Air bags are for a front end collision, if you rolled sideways and hit the tree I would say no.

please state year/make/model next time.

there are no airbag sensors on the sides of a car. rolling over won't activate an airbag sensor.
the sensors are on the front and rear of the vehicle and are activated by impact.
