Our car was parked outside of our house and a lady hit the front of it. The whole driver's side is completely smashed into the tire and it is not driveable. We have all of her information and filed a police report. Her insurance is not open tonight. So, we called our insurance and they said we would have to pay out of pocket for a rental car.
Shouldn't her insurance be the one to pay for a rental car? We have absolutely no money to pay for one even if it is reimbursed. Our insurance also told us that we have car rental insurance but it is still $25 a day and we also have loss of use insurance.
We are calling the other lady's insurance tomorrow but I am so stressed that they won't pay.
What do we do?

We have full coverage on the car. And we do have rental car insurance but apparently we still have to pay $25 out of pocket.

In order for your company to pay for you to have a rental car-you would have to have purchased rental reimbursement coverage.
Apparently you did not purchase that coverage so you company can not pay for you to get a rental car.

In order for your company to pay for the damage to your car - you would have to have collision coverage. They would pay for the damage less your deductible.

You can file a claim with the other ladies insurance company. They will have to do an investigation. They will not be able to provide you a rental car when you call to report the claim.

As part of the investigation - they will look at your car and their insureds car. They may take a statement from you. They will also have to speak to their driver and confirm what happened.

If the other lady confirms what happened - then her insurance company will be able to work pretty quickly. If the lady disputes it -then her company will have to look into the matter a little further.

At this point - you turn in the claim - cooperate with the insurance adjuster and let the process work itself out.

It seems to me that the owner of the other car is at fault so there insurance will pick up the rental cost of the car. Call the other party's insurance co and ask them for a claim number and also ask them for a rental co that they deal with.

Take a deep breath and calm down. Her insurance should take care of all the damage and a rental for you if you need one while your car is being repaired. Does her company not have a 24 hour number to call? Most do any more. All will be taken care of....just relax.

Don't panic until you talk to the other insurance company. They may pay for a rental car. Your company can't tell you what her policy covers.

calm down her ins is rosponcible for all damages to your vehicle as it was parked when hit contact them and all your problems should be solved if not worst case you may have to file suite against your ins co to get things covered do not sign anything for either company have an attorney look at all offers from both ins cos make sure your best intrest is protected

get the tire iron out of your trunk and go ask her to pay for a rental for you.
