If you have blackjack and the dealer has blackjack, then it is a push. If you get blackjack and the dealer eventually gets 21, you still win 3:2 at most tables.

At most houses this would be a push.
If you play happy 21 the black jack gets paid anyway. But, 1 to 1.
At this table a 5 card charlie(21) also wins 2 to 1 and 6 cards under 21 will be paid automatically. The suited diamond blackJack is also 2 to 1
At most houses also, if you have 21 and the dealer shows an Ace you can ask for even money.

If you and the dealer both get blackjack it is a tie (push). If the dealer has an Ace showing and you're foolish enough to take insurance, and blackjack pays 3:2, you'll get an even money win regardless of what the dealer has. Insurance is a bad bet unless you are card counting and know it is advantageous for that particular hand. Otherwise blackjack pays 3:2. If you see one of those ripoff 6:5 blackjack tables, stay away.

21 is the highest you can get without going over. Anytime the dealer gets higher than you w/out going over, they win automaticlly. Yes, the dealer would win if you both got blackjack.
