I have a new neighbor and she has a dog. Well the dog barks as soon as she walks out the door and doesn't stop barking and scratching the door until she comes back. I have talk to my landlord about this but I know he is having a affair with her so him doing something about it just won't work. Anyway I got into a aguement with her over the dog and she is just acting like she doesn't care. I need to know what I can do as a tenant to make her do something about it. PLEASE HELP ME I FEEL TRAPPED.

It varies from state to state, county to county, city to city - and YES, even building to building...

Talk to your super, and find out the building's policy on animals - and if they won't take action (IF appropriate), then go to the city (or the housing tribunal) and get THEM to take action ;););)

Unfortunately, that's what apartment living is like, especially in one that accepts dogs. (I know...I live in an apartment...)

If the dog is barking during certain hours (early morning, night,) you can call the police and file an disturbing the peace report. If it is during the day, you can still try, but I'm not sure what the outcome would be.

Also, try talking to her again. Only this time, do not argue. A guarenteed way to completely demolish any hope of cooperation is to be threatening or combative. Try something along the lines of...."I notice your dog really misses you when you leave for work. However, I'm working on a paper and I have some trouble concentrating with his barking. Do you think there is anything that might help keep him occupied while your gone...a new toy perhaps?" If you are kind, respectful, and even offer helpful advice...you'll get a lot more from her. -You catch more flies with honey-

Does the landlord own the apartments or is he managing it for a corporation or other owners? If so then you can contact them and report the situation. If not then you can indeed contact the local authorities and report a 'nuisance barker' -- most city regs allow for sitations for this sort of issue. I know in our city it is something like repeatedly or over fifteen minutes or something like that... but it shouldn't be going on to the point where it disturbs others - don't know if they would site the landlord or the person or both (which is who I would report - both of them as you have tried to remedy the situation by informing them of the nuisance and they chose to ignore).

If she is violating the rental agreement, the landlord needs to do something about it. If not, check with your city for noise ordinances - they might be able to ticket her. The poor dog obviously has separation anxiety issues.

Record the barking on a video camera, and maybe you can sue her and the landlord (if he doesn't respond to your complaints).
