Simple Scenario: I was driving and stopped for a school bus. The driver behind me hit my car. I felt one impact. Damage was front his front bumper and my rear. No damage was found on his rear at scene of accident. Situation was written by police officer for following to close for driver of vehicle that hit mine. Driver who hit me claims that a phantom vehicle behind him came in contact with his vehicle which caused it to hit mine. Police officer did not pay much attention to this but I assume he probably took note of that.

We both have the same insurance company. My agent is telling me that my deductable is not waived that I may have to pay it due to the possibility of the phantom vehicle being involved.

My question: Why would I pay for the claim out of my coverage when a ticket was issued by a police officer in my favor and there is no actual evidence to conclude this phantom vehicle? I am the victim and I am paying 100%.

you ALWAYS i repeat ALWAYS have to pay your deductible when going through YOUR POLICY regardless of fault.

Since they havent determined liability yet under dude #2's policy.. your only choice if you want repairs RIGHT NOW is to go through your own.

You are welcome to wait around while they investigate and determine liability and if they eventually find him at fault.. then you can go through HIS policy free of charge.

Make sense?

Its not just "oh the other guys at fault" and LIKE THAT you suddenly dont have to pay your deductible on your own policy. If you want to get itdone free.. you have to go through his and that takes time (although, i think they will probably accept liability under his claim eventually if there truly is no damage to the rear of his vehicle)

and btw... please someone tell me... why on earth they think the insurance company would be doing this for fun. It amazes me how people think insurance tries to "screw you over". So your telling me.. that when there other customer says there was a 3rd vehicle.. they shouldnt investigate that for someone who pays them monthly?

How on earth would they benefit if this girl goes through her own policy instead? regardless they are still paying for the loss! Uneducated stupid people who think the world is out to get them crack me up

Wait...your insurance agent is telling you that you'll pay for the REPAIR, or the DEDUCTIBLE?

Because if it's the former, you're getting screwed. I'd look into getting a lawyer, if the damage is bad. I'd definitely threaten to contact your state/country/whatever's insurance regulators, and Consumerist.com and whoever else covers stories like this.

If it's the latter, well, there it's more ambiguous.

If there was no damage to your attacker's bumper, he's lying. You shouldn't be paying for anything.

If there is, he might not be lying, it might not be the fault of anyone whose insurance is actually involved, and he shouldn't be paying your deductible.

Regardless, the insurance company could just be trying to weasel out of it.

I'm not religious, but I do have heavy sociological / anthropological background. If you feel the need to "fear" your God, then it's because you feel guilty for something, or you want to feel victimized. Most folks don't fear their God. They love their God. God is like the ultimate leader. As Machiavelli said, a good leader must be both loved and feared. If he is just loved, then people will still do what they want against his wishes at times. If he is just feared, then they won't love their own lives, only doing what he wants out of fear of ramifications. If they love and fear him, then they will do what he wants out of love and respect first, and out of fear second. Let me try to use a different analogy for God... God, in most peoples' eyes, is like a good parent. A good parent uses 2 parts love and 1 part discipline to ensure people lead a good life. 1 part love is unconditional. God loves you unconditionally, because you are his creation. (Just as a parent loves their child unconditionally). 1 part love is for positive reinforcement. God shows you love to reward your good behavior. This is what most folks call "blessings", "miracles", etc. Parents do the same with them children; give them hugs when they succeed. 1 part discipline is used for negative reinforcement. God punishes people when they've been bad. Parents do the same to children. Now, most people will follow a Godly life simply because they respect and love God due to 1 part unconditional love, and 1 part positive reinforcement. If that doesn't work then they fear the 1 part discipline. However, what's "blessing" and "punishment" from God is subjective. Different religions, and even individuals, may see something as a blessing while others see it as a curse. Everyone can see whatever they want into something. When a mother hugs a child, it's pretty tangible that it's a hug. But, when a person finds $5 on the street is that a blessing? What if it just enables them to do something bad? I think the better way to look at God is that he gives people chances. The $5 is an opportunity. How the person chooses to use that opportunity dictates whether it's a "blessing" or "curse".

You're being screwed, basically. The collision is not your fault, your claim is against the other driver & his insurance policy - he hit you, simple as that. You should not be out of pocket. Don't stand for the insurers trying to wriggle out of it.

The business with the "phantom" car is not your problem. I suspect the police officer didn't believe it. Either.

thats bull crap, i would take that to court, nothing wrong with sueing your own insurace company , i'm sure your not going to keep them anyway after this. there's no way you should have to pay anything. you were hit in the rear and the other person got the ticket, any judge is going to go in your favor, but be sure when you make the law suit in small claims court of course, you name the insurance company and the person that hit you

You may have to sue the other driver for your deductible which then his insurance should pay him ,if he persues it .
Remimber the insurance wants to get out of this for as cheap as possable.
