In the U.S. a person caught with only 5 grams of crack-cocaine is automatically sentenced to 5 years in state prison. I don't know who came up with these ridiculous laws but not even child molesters and robbers get 5 years!

It's much too harsh, and it's unfair. People with drug problems need help, not prison, and it would be better for society for these people to become productive members. Also the penalty is simply unfair. The sentences for real cocaine are typically much less. So this is another example of treating the poor worse than the rich. . .

5grams is a pretty substantial amount of dope when you think about it. This may fall into intent to distribute. Feel lucky it's not meth. I believe under the new guidelines it carries a minimum of 20 to life. I do agree that prison isn't doing anything for these people. They should be locked into a Tech school with on-premise D&A rehab. I'd be willing to bet that most of these people would stop the drugs if they were able to get jobs that they are interested in. Prison only serves to create outlaws. There's nothing even close to reform going on there! Bubba is not going to reform a person by raping him.

No. If it's for personal use in a safe environment, why were they on the street to get caught? Since they weren't in a safe environment, they're a danger to society. The effects of crack are varied and usually worse than other recreational drugs. If we go by that, execute the dealers, give 10 to life to first offenders(depending on the circumstances under which they were caught), and give life-without -parole to 3-time users. It's not the drug, it's the consequences of the use of the drug.

You are wrong. It is not automatic that a person caught with 5 grams of cocaine is automatically sentenced to five years in prison, but it should be. Drugs are a scourge on our society. Look at what drugs have done to people. These druggies commit crimes to support their habit and destroy other people's lives in the process They should be put away. Never trust a cocaine user or cocaine dealer.

Do you know how much 5 grams is?

Your typical $10.00 rock for one addict to smoke is maybe a hair over a quarter gram (0.25 Grams, one twenty-fifth of a gram).

That would make someone in possession of 5 grams, in possession of about 20 rocks. That is a dealer, that is a death peddler.

5 years is fine.

5 grams is quite a bit; however isn't there a 1st offender program in your state (if you are 1st offender)? Did they get you for intent to distribute? I do think the sentence is ridiculous. I think it depends on what state you got caught in.

I think that anyone who does drugs just needs to be droped off a 2 miles from shore out in the ocean and the ones who survive are the ones who can be let back into society with no more punishment tell thier next offense.

Yes, I do.

Whole-heartedly.

The whole purpose of such laws is simply to have a legalistic method of removing from the local society those whom the local governments have failed to protect from such vices.

"We failed you, but we don't want to admit that it was we who failed you, nor do we want to take responsibility for having failed you, we simply want to get you out of sight of the many people we aim to impress, lest we lose our jobs and thence our income. So, get out of our way so we can fail to protect more people just like you."

That is all such laws are saying.
