yes if they ban all foreign flags which they probably do. they also probably ban obscene language and pictures on lunch boxes.

This sounds illegal to me, I don't think they have the right to do that. If they were banning something more general, like no decals on lunchboxes, that would probably be ok. I would want to find out if an American flag decal is allowed? If so, then I think they are violating your daughter's first amendment right to freedom of speech.
Assuming they are banning the decal because it is a Mexican flag, I agree with the person that said to contact the ACLU. They can probably help you with sending a letter to the principal, school board, or school district to demand that they respect the first amendment rights of your daughter. If that doesn't work, you will probably need to sue the school district, and perhaps they would help with that.

Yes. They tried to say kids couldn't fly the US flag or have a US decal because it 'caused trouble' with kids in the US who hate the US enough to consider that provocative. That they backed down on, but no other flags in school, in some areas, at least until the Supreme Court rules on it. In some areas that one is a gang symbol. Sorry. Freedom of speech should be protected and gangs should be outlawed on their own merits, not by association with a nation's flag.

Some schools have banned certain color combinations of clothes, or wearing a hat a certain way because it signifies membership in an unauthorized club.
Schools often ban non-school sponsored clubs and fraternities/sororities. If the Mexican flag has been adopted as a sign of a club or gang, the school has every right to ban it.
I certainly think you should get more information from the school.

public schools have greater latitude under the law. in other words what is allowed out of school is not always allowed in school or vice versa. for instance you may refuse the searching of a backpack on a public street but you cannot refuse the search in public school. a public school has the right to ban whatever it considers disruptive and at this time my guess is that they consider a mexican flag displayed on school grounds disruptive.

School boards can regulate rude and/or offensive material: Clothes, decals, patches, signs, etc..
Most Americans are sick and tired of seeing the Mexican flag in America.
If you want to display the flag, do it in your own home. If you want to display the flag outside of your home, the US flag must be of equal dimensions, and have a dominant position.

I guess it all depends on the laws of the area where you live, and the school's policies. I don't see a flag on a lunchbox in the same category as a foreign flag flying on a pole on U.S. soil. My husband has a jacket that he wears that is corporate issued, a foreigned owned company. On it are the US, Swiss, and Canadian flags, with the U.S. flag given a spot of prominence. He is neither Swiss nor Canadian, but he wears it. It is designed as a symbol of countries working together, not as an act of defiance or disrespect.
Ask the school if they'd object if she adds the U.S. flag, or even flags of several countries.

Heck yeah it is. If schools are turning Halloween into friggin Orange and Black day, than I would expect them to turn away a decal of a flag. Some do not even say the Pledge of Allegiance.. or allow their students to NOT respect this nation...
I fear only my future..in 30 plus years these very people are going to be looking out for my best interests in my Golden Age.. That is what I fear.. think about it once.

This is a little questionable. If it is promoting racial tensions at the school, they could ban it. But if they are doing it for arbitrary reasons, it may well be found unconstitutional. ACLU lawsuit comes to mind....

How unbelievably petty! Since when is it not ok to be proud of ones heritage? One of the best things about America is that it is multiracial. All stupid rules like this do is to further inflame racial tension and divide communities on the basis of culture. I would speak with the school about this & find out what the specific problem with the lunchbox sticker is. Remind them that your daughter does not wear her lunchbox and thus the 'offensive' sticker is only seen twice a day. All I can say is that I hope your daughters school is conducting random drug tests and checks for firearms regularly instead of getting so concerned about a damn sticker. Good luck.

Please share with us which school this is. I suspect that further research will lead to a whole different story than you have provided. Perhaps it never happened and you are just trying to start a flame war. Or maybe you have been lied to by your daughter. Perhaps she was told this by someone with no authority to dictate school policy. If you give us the name and location of the school we can resolve this issue swiftly.
