My husband had to go out of the country he is going to be out for about a year he worked most of this year can i still file his taxes without him being in the u.s. ? help

As others have said you do not want to file separately. Another option is to get a Power of Attorney. This is what military families do when one spouse is deployed. Since he is already out of the country you may need to start with the company he works for and see if there is a way to get one done.

You have until April 15 2008 to file your taxes. Contact your husband. Filing "Married Filing Separately" is the least desirable filing status to ever use.

1. Even if your husband is out of the country, he must file his tax return. He will also report any income he has in the foreign country. The U.S. taxes your world wide income, and you may be able to get credit for taxes paid in the foreign country.

2. If you file as Married Filing Jointly the return must also be signed by your husband. (Make sure to get his signature to avoid any future complications).

I agree with Bostonian. What you don't want to do is file married filing separately since you both will lose benefits. Best to file MFJ and just plan ahead. You have lots of time to get all your ducks in a row.

Filing a joint return requires both of you to sign the return. He can prepare it, sign it and send it to you for your signature, and then you can mail it off. (He could file a separate return but that would be costly in your situation.)

He should get a copy of IRS Pub 54 from the IRS website as there are a number of special rules and potential benefits for US citizens working overseas.
