They both can for the time period they had her. It would be a prorated deduction.

as long as only one files... it does not matter. however... i believe that the person that has her at the time of the filing... would win... if you could not reach an agreement between the three of you. possesion as they say. that six month thing...is not true. that is why folks are happy when baby is born before december is over... or you get married just before yr is over. it is not about how long... it is getting it in..before the yr ends.

first of all thats 13 months. anyway in order to claim someone on your tax return as a dependant you would need to have supported her for more then 6 months. since none of you had her for more then 6 months then none can claim her.
