We are now living together here in Canada. My question is how can I marry (or what are the things to prepare) her as she can't go back to her country to get an annulment as no divorce in her country. Thanks I appreciate sincere comments.

You can marry in Canada because the Philippine laws is inoperative and does not apply in Canada. Annulment is not needed with regards to the Canadian laws on marriage but the marriage will be only relevantly for a bigamy case in the Philippines.

she can get an annulment in the philippines. she can't get a divorce but she can definitely get an annulment. they're two different things.

if her marriage in the philippines was recognized legally... meaning she has a marriage certificate... then you can't marry her. she would then be guilty of bigamy which is one of the grounds of denial for a spousal visa for canada. she has to present papers that her prior marriage was dissolved before you can apply for her as your spouse/fiancee. canada does recognize marriages from other countries.

Obviously you cannot marry her if she already is married. She needs to get an annulment or divorce, and if that is not possible, they you still cannot marry her.
