The earliest you can file is typically 1/15/2008.

If you don't file at all you won't be able to request a certificate of non-filing until May or June 2008 (that's the earliest the IRS will be able to tell if you apparently don't have any w-2s or 1099s for the year 2007).

You have to wait until after January 1. But, if you have no income why submit one? Tell them that you did not have income. You can be fined for filing a frivolous return if you have no income and file anyway.

If you have no income, you don't have anything to file. And the IRS doesn't accept returns until January 1 by mail, mid-January by efile.

You have to wait until January 1, otherwise you could make money at the end of the year and not pay taxes.
