Can a guy get his money back if the paternity test proves the child is not his?

So sorry I should have elaborated, he had been paying child support of a child he didn't know he had for almost three years, now he found out it's not his. It was a one nite stand.

if it was court ordered, maybe. If he asked for it and it was done outside of court, no.

No. you pay for the test up-front.

If you mean support payments?

No...and it is likely he'll have to continue payments under "Presumptive Paternity" legislation. Unless you can prove someone else is the father and (your guy is) willing to permanently sever all connection with what he thought was his kid. In any case...check with a Family Law expert.

I think that would be specific to what state you are in and what laws they have instated. I've read several stories on yahoo and other news sites of men who have to pay child support even after its been established that they aren't the father just becuase they put themselves forward as the child's father.

Ummm... i don't think he can get his money back, actually i'm pretty sure he can't get his money back regardless of the results!! He paid for it to find out something and he knew what he was paying for, so he's basically screwed at this point in time!! Sorry :(

no, money is used to generate paternity tests and the technitions need to get paid too
