Do they become a citizen? Or what happens?

No, they don't become a citizen.

Their being illegal to begin with, since 9/11, means they might never be allowed back into the country if they leave, but that is up to homeland security.

If you really love the person, marry them in their country, and live with them there, or marry them in their own country, then come back up, make enough $$ to support them, then file papers to bring them up on a spousal visa.

That process takes roughly 1-2 years to complete. If homeland security approves the visa, and border patrol lets him CROSS (just because you have a visa doesn't mean the b.p. will let you come over.), then you can continue your paperwork to remove conditions on his status.

Best of luck. My husband wasn't illegal, but the process would have taken us 4 years from start to finish....however, we had an emergency situation (a death, specifically), and my congressman helped me get my husband up here in 2 months on a visitors visa, instead of 14 months. It took us 2.5 additional years to get him his permanent residency.

Hope this helps...best of luck to you.

Nothing happens, if the INS finds out that the person is illegal, they get deported. You cannot become a citizen as a non immigrant, you have to first become a permanent resident, and then a citizen.

Ideally, the person should go back to their country and come back on a visa (work, tourist) so that they are out of the illegal status.

They dont become citizens. You can petition for them to get legal.

If they entered the US legally and overstayed, the process is a lot easier.

If they entered illegally, the process is expensive, stressful and long. They will have to leave and go back to their home country and have an interview. You, as the USC, must prove that without your spouse, you would have considerable hardship.

Here are the steps outlined:

Nothing happens. They dont become citizens, by marrying you. Now if you want him to become legal you petition for him. Its a process but its well worth it.

nothing...unless you petition for them. then you will have to go through this whole process. its better for them to go back to mexico, and you get a fiance visa, then they are allowed to come over, so you can get married. then you would have to file another petition in a certain amount of time for them to be allowed to stay here while waiting for an approval or denial.

did i answer your question? hope so!

p.s. dont listen to all the meanies who just want you to feel stupid,... when really its unjustified because you CAN do it, i have, and you can too. forget them.

Personally I think you should be arrested and punished for aiding and abeting a Federal felon.

ILLEGAL INVADERS have no right to be in this country and anyone who supports them should be punished.

Just my opinion, and becasue I live in the UNITED STATES OF AMERICA I am FREE to voice my opinion.
