If a child is apprehended, & you're not sure if you should get a new lawyer or not (Legal Aid, btw) when should you consider getting a new one ? What if you're concerned bout the time factor cuz you don't know where your son/daughter will be on Christmas day ? What's the first sign of getting a new lawyer ? If someone has cases that are similar to the one you have, should you consider him to be an expert ? What if he/she isn't doing what you want & seems to be on the other side ? Again, time is a factor cuz of the holidays. Should you go ahead when you're not sure if the other party involved has a lawyer yet or not ? Could you be wasting precious time by getting a new one ? What are some things that you should know bout your lawyer (what he/she thinks should be done to win your case) Do lawyers have to win to make $ ? Is that the motivation behind it ? Thanx for getting back to me so quickly :) Didn't expect that there'd be as many replies. Anywayz, my child's father is fighting for custody of my son (I don't wanna say "our" cuz he's being a jerk) Also, how much time should your lawyer spend w/ you during the initial mtg ? I'm considering getting a new lawyer on Mon. It seemed like he was in a rush to get me out of his office even !:( When I kept on adding details, he sighed. :( His dad's fighting for custody. So now HE has a lawyer, or is GETTING one...Pretty much everyone who I've talked to say "they can't take him away for that !" no matter WHO I talk to... well.. cept for maybe 1 or 2 peeps. (peeps in organizations) Basically it's in regards to safety. I actually have to have SUPERVISED visits ! I'm tryna transfer my file to a diff't agency cuz according to what I'm hearing, this one agency shouldn't even be involved. They're exagerating too. If it's over safety reasons, can they ask your former counsellor bout you w/o consent ?

first off this is sad but true money talks. are they trying to reach the goal u want,remember they work for u no matter legal aide or not. when your explain your case are they sympathetic to u. r they showing positive signs that they can get the result u want?(they can not say if u will win or not) if u r fighting for something u believe u should make every sacrifice to get the best representation u can.

ask the lawyer you have (or that your child has) what is his/her plan and strategy,

what is the best outcome he/she thinks is reasonable,
what outcome is most likely
what is the worst case outcome.

You might also ask how many other cases the lawyer is handling.

Ask if there is anything that can be done to speed things up.

If not, ask for a copy of all case work, so you can get a second opinion from another lawyer. talk to the other lawyer before making the decision to change.

Most lawyers get paid whether they win or not. It is possible that legal aid lawyers are volunteering their time - it depends on where you live.

There is most likely a reason why your attorney is not moving as fast as you wish. I am sure there are issues as to why your child had been apprehended. You have not said who took the child? If it was family services then they had a reason. If it was the child's father, then maybe you do need a different attorney. best of answers. Also the courts are busy tying up cases before the end of the year. A case like this one may takes years. You need to tell us why the child has been taken so we can give better advise.

Is this a spouse or parent who has taken the child?

I'd say if they havent gone to the federal government (taking a child out of state or without permission is a federal offense), the police, or reached any point of progress after a few weeks its time for a new lawyer.

if your lawyer is not being responsive to your questions and explaining to your satisfaction why things are happening the way they are, it's time to get a new lawyer. also, you (not the lawyer) are ultimately the decision-maker about how to proceed. they are representing you and your interests. if your lawyer "isn't doing what you want" you need to talk to them about why (do keep in mind that there might be a good legal reason why you should or must do it differently than you might have originally envisioned). If they can't explain to you why they want to or have to do it another way, then switch lawyers. also, if your lawyer is missing deadlines or anything like that, definitely switch lawyers and report them to the bar association.

You got a free lawyer! AND you don't have to stay with the same one if you don't like him? Must be nice. If you was paying for this lawyer and had to put down a deposit of thousands of dollars for another one (LIKE MOST FOLK DO!) would you change lawyers mid-stream?
