Details are they lived there for a year but got in some fininicial trouble, lies, looked to me as they were bi polar.

I would give an ultimatum and deadline!! Unless your bank won't resubmit the check, I would keep calling their bank (on possible paydays) and as soon as the bank says the money is in there RUN to your bank (preferably their bank if there's one locally).

You have 2 possible legal options:

1. Report it as a bad check; They may respond if contacted through the police. BUT the police will only prosecute the bad check chances are they will not pursue getting your money back for you.

2. You can go to small claims court, you will initially pay the court fees to file and most courts will order payment of those costs to you IF you win.

If you obtain a judgment against them it will remain on their credit report until satisfied. This could cause them alot of problems so they may want to take care of it. You can also get from the Clerk of Court an "Execution of Judgment" where the Sheriff is sent to collect any assets in order to satisfy the judgment. Some states have a time limit on these judgments and you may have to renew it.

I would recommend trying the first couple options first, they're much less hassle!

You can sue her in small claims court.

Depending on where you are, you may also have the right to recover additional damages - in some cases up to three times the value of the checks - but you have to follow specific steps to get them, so check your States laws.

What's the problem with making a decision? Take them to small claims court. Even if they do not Answer or appear, you can get a judgment against them.

If she won't make good on them, sue her in small claims court.
