Stalking is illegal because it is harrassing and invading someone's privacy. Why should photographers be allowed to harass and invade celebrities' privacy just because they can sell their pictures? Isn't everyone who buys their pictures a stalker by proxy, paying the paparazzi to stalk celebrities for them? Wikipedia says: Paparazzi is a term for photographers who take candid photographs of celebrities, usually by relentlessly shadowing them in their public and private activities. Celebrities claiming to have been hounded by such photographers often use "paparazzi" and even "stalkarazzi" as a pejorative term.

There's such a thing as "Freedom of the Press". Reporters and newspapers have this right that allows them to gather information for public distribution. Unless the government specifically distinguishes certain information as confidential or private, then the press is free to do almost anything.

This freedom is necessary for a democratic society. People need to be aware of what is going on and other people have the right to show them/make them aware of what's going on. The paparazzi are protected by the fact that it's all a part of their job. They can't expect the news to come flying into their desks.

As long as they don't go to desperate measures and if the circumstances are not extreme, paparazzi doing what paparazzis do, isn't considered stalking.

Stalking to take pictures of celebrities is legal as long as it's on public places or it's on a private thirdparty property and its owner doesn't mind.

Celebrities get their fame and financial success due to public spending money on their movies or music concerts. Most celebrities are expected to "give back" by sitting for interviews, posing for pictures, etc. For this reason few celebrities can win anything in court for being stalked, unless it's for something defamatory.

I bet when some actress gets a picture snapped of her topless by these "stalkers" and is on the cover of dozens of magazines she is just devastated. How can people who want to be famous deal with all that publicity?

Yeah, wouldn't ya think so? I think it's outrageous. Their claim is if people will buy it they should be able to do it. But your average person is a nosy bastard so why make it legal to indulge their nosiness?
