and how long do i have to file an appeal / defense? can i file for a restitution of conjugal rights after the petition for divorce has been put into court , we dont really have a problem with each other ,her parents hate the sight of me and shes being railroaded into filing,we live in india , karnataka

Why don’t you both guys compromise & go in for divorce by mutual consent rather her filling a divorce petition on the grounds of mental cruelty & you defending her petition or later filling a petition for restitution of conjugal rights. Do you people know all this litigation can take 8 to 10 years to decide by the time you will be of middle age & left with no better option for getting a suitable match latter on for remarriage. All these type of matrimonial & divorce litigations lead you no where but just running from family court to Supreme Court & wasting time, money & energy. If you both are unable to live together then better call it a day now itself & compromise for divorce by mutual consent just dissolving this marriage within 6- 8 months or so time frame. How long it will take for you to get court summon can be any time from one to one & half month, & you file your defense on the date mentioned in the summon to appear before the family court to file your defense, after that just dates after dates from months to years keep on passing.

Depends on the state you in which you reside. I will give you an example of Ohio. Typically after filing, it takes 2-3 weeks for the court to get back with you to tell you if any documentation is in need of correction. This is done by mail. The divorce/ dissolution hearing is set for no less than 30 days and no more than 90 days from the filing of the paperwork. If paperwork was needing to be amended, it may be from the time of the filing of amended paperwork.

Restitution of conjugal rights sounds like sleeping together still. If she has filed on grounds of mental cruelty, is that the wisest thing to do? You're going to be unconscious next to someone who clearly does not hold a small amount of anger or at least relationship angst towards you.

Be smart. Think it through.

The court summons all depends on which state you live. As for the restitution of conjugal rights, well there is no way ANY court in the USA is going to give you the ok (court order) to rape your ex-wife! If she is leaving you and getting a divorce, it is obvious she doesn't want you. What kind of mental issue do you have? This must be a joke question.

It will take around 8 to 10 years for you to come to the final petition. Then it will be too old, go for compromise.

Call her every hour to ask this question 24 hours a day every day until she answers this question. Tell her that she is lucky she hasn;t been injured. Key her car. Demand conjugal rights irregardless of what the court says. Hang around the neighborhood and let her see you—make shooting gestures with your fingers. Do not bother getting advice from your lawyer..
