Answering this question requires tying yourself in a legal knot. Smoking is not allowed on Federal Property, and of course the White House is Federal Property.

Actually, the First Floor is considered Federal Property -- the 2nd floor is the official residence of the President and his family, and by law, it is considered his home. So upstairs, in the family area, it's just like his home.

Another strange example of this is fundraising. No Federal Employee may use Federal Property to raise funds for a political campaign. So when the President has to contact someone about a fundraiser, by law, he has to go upstairs!

Good question. It seems like the President should be able to smoke if they want to, at least in their private rooms, just like anyone could smoke in their house. But since their house is owned by the government I don't know. I'm sure they wouldn't smoke because it's not socially acceptable right now, but they should be able to live as freely as the rest of us in their off time.

Seriously though, I guess the President would be able to smoke in the White House if they wanted to.

I guess we will find out if Obama wins. But wouldn't it be comical to see him standing out in the rain 50 feet away from any entrance every time he wants to smoke (that's the rule in all other Federal Buildings anyway). Just that might make it worthwhile to see him elected.

Yes you can, the federal government continently exempts it self from laws that you and I must abide by. Such as the ADA and ERA. Oddly enough it was the Democrats who fought for those exemptions.

No, it is only on loan for their time in office, but I do think that Laura Bush does smoke

No I don't believe you can as it's a federal building.. BUT i think it's wrong... Not 100% positive though.
