After a legal adoption by your husband, the old birth certificate would be sealed and the new one would be put in its place. This can only be done by courts (usually family). An absent father still has rights (even if not on the original certificate), and must be notified (in multiple cities if there is no idea of his whereabouts). The birth father has to sign away all rights to the child. Then when the child as an adult would request a birth cert, he would get the new one.

Yes. if he legally adopts the child he becomes the father just as if he was the biological parent. You will have to request the new birth certificate.

There's really no legal justification for that. He's the child's father by choice if he adopts, not the biological father. The law wisely insists on making that distinction, for the child's protection.

Once your husand adopts your child, his name will be added to the cert, problem is if you guys get divorced, god forbid you do, the courts will look at it like he is the father and will be ordered for child support, and if something happens to you, the child will go to him first as the legal binding father.

I guess it depends on the state. Cause I had your same case and the state of New York send me a new B.C. with my husbands name on it after the adoption. So the answer is YES (depending on your state). Good luck!
