The person I beat in court failed top notify myself or the court he lost in of his attempt to bankrupt. I have asked the judge and US court what to do. Is it still ok to finish my case and seize all his property before the court gets it or wait till they get him first. The US court siad I was not listed so it leaves me open or I can add myself and force him into Capter 11 or 13 instead of 7. does anyone have anything to add?

Yes, do what your attorney tells you.

You need to speak with an attorney who practices in International Law. You have several options, but none of them are all that good. Go get a phone book and contact an attorney in the jurisdiction in which this person lives.

Failing to list a debt such as a judgment in a bankruptcy petition can end the entire bankruptcy process.

Is your debt a significant amount in terms of his bankruptcy?

If it's an amount that you believe he should be able to afford to pay you, then you might choose to contact him and remind him that he forgot to list it in the petition and that if you have to have the court add it, he could lose all his bankruptcy protection.

If he doesn't pay you, then contact the bankruptcy court and ask them to add you as a creditor.

You might want to talk to a bankruptcy lawyer... the exact timing of your court case and his bankruptcy case can be important.
