Tomorrow I have to break the news to my landlord, roommate and roommate's parents, who are his guardians.

I am getting married and I hate my roommate who is an unemployed,slob,noisy, mama's boy. I have called the cops on his aggressive and psychotic behavior twice.

I know they can sue me for breaking it but I can't be apart from my fiance any longer and it's unbearable here. I am nervous about speaking to everyone.

ANY ADVICE ON WHAT TO SAY TO ALL PARTIES INVOLVED?

If the conditions are unbarable then depending on which state they can't sue you. Are you giving a notice? In some states you don't even have to give a notice if your roommate is acting like that. Just make sure if they did ever try and sue you that you mention the son's behaviour and not that you moved out because you got married. I would make that the main focus of the reason you give them for you moving. then that way they shouldn't be able to say anything about it. Make sure you do get a copy of the police report if you can for when you had to call the cops. Good luck

Why would you be nervous about it? Getting away from the psycho roommate from hell should have been your #1 priority. I would have not been there in the first place, or left when his behavior became violent.

Send all parties a written notice. You may be liable for half of the rent if psychoboy's parents don't ante up until the lease terminates. Have your fiance and friends come and get your belongings. Just state marriage as the reason, so you don't have to worry about slander (even though I notice he isn't living with his mother).

Don't be so thankful yet. What you have described is NOT a valid reason to terminate a lease. It's a valid reason for you to move out, but it's not going to relieve you of the contract for which you signed. Your best bet is to beg of the common sense of the parents, who are the guardians of the loony roommate. I suspect that the parents have already co-signed the lease, since they are the legal guardians of this guy. In fact, if the guy has been declared mentally incompetent, he may not be able to legally sign a lease on his own.

Don't expect that you will be let off the hook as others suggest. It's not the landlord's fault that you signed on with a loony. The landlord will move to protect his interests in court, and you will probably lose that battle.

Don't use marriage as the reason. Anyone could say why not just share a bedroom with her!

No, your reasoning is safety. This way you can use the police report, etc. so that you break the lease according to the terms outlines in your lease agreement.

You do have a written lease agreement don't you? If not, then you're nearly home free. Notice should be fine.

p.s. Now you don't have to get married...If you just want warm toes, get a dog.

There are laws that protect you also. If they have cause trouble like this then legally even if they take you to court then you can still win the case. The landlord does need to give the tenant at least a 30 day notice to move out though and state the exact reason why then its become legal to kick them out. I say for it and don't look back.
