Hmm I never heard of a store doing something like that. I think they were just trying to yank your chain; scare you into not doing that again.

If they didn't call the police then and there, chances are they aren't going to call them. However, they do have your information and can opt to call them at a later time. If the loss prevention employee told you that you will be receiving information from one of K-Mart's attorneys, chances are you won't go to court, unless you refuse to cooperate, or get your own attorney to fight it. I haven't heard of something of this nature being handled in this manner before, so I have no idea about the cost of the fine. I wouldn't worry much about going to jail or court but chalk it up as a lesson learned.

They can file a police report without you being present. I think what they are trying to do is let you off with a warning. Pay the fine and don't do something like that again. Next time, it will end up on your record.

Don't worry they sound like they were trying to scare the sh*te out of you (and succeeding!).

Don't do it again and you'll be OK. If you get caught again they might bring this one up as well.
