I have to leave my 2 five year olds and 12 year old son home alone once in awhile due to my job, and I am worried my ex will be able to somehow use this against me. Is it illegal?

I seem to be getting scolded for this, but you must understand that my situation right now leaves me with no other choice. I am a single mom and can't afford to pay for child care....My son did take cpr classes in school, and we hace gone over all emergency situations over and over again, including cuts/bruises,breaks, fire etc.

I was looking this up on various web sites and it looks like you could be in trouble. One site said children 8-9 could be left home alone for 1-2 hours. Most of the sites seemed to recommend that a child who is responsible for younger children should be at least 14. That means your 12 year old is not considered old enough to be responsible for his siblings in the eyes of the law or social services, even though he is more mature for his age than most 14 year olds. You need to get your ex to come through with more child support so that you can hire someone to stay with the children while you are at work.

I know that it's hard not having someone to look after your kids. I actually think that 12 years old is old enough to leave them home alone. I was babysitting by then, for other families, and I did just fine. It would be good to talk to the local police department to see if it is illegal. One place to look for a sitter is your church, there are always teenagers looking to make a few extra dollars, and they are generally very sweet and flexible.

It's a good chance your ex can get you into trouble. I had a friend who left a 15 year old home and he was harrassed by a kid from school. Short version when they called the police the police threatened her for him being home alone! even at 15 ... go figure.

First off, if it's illegal where you are (or immoral) your ex isn't "getting you into trouble"! You are the one doing it. Take responsibility. The fact that you are questioning it and fearing trouble indicates that you think it is wrong too. Go with your gut.

I would suggest you call your ex and ask for help as I believe he is equally responsible for the welfare of the kids.

Sometimes the solutions aren't easy BUT there is always a solution.

I think the legal age for a babysitter in my state is 13. So you're close.

yeah it probably is but depending on where you live it might be different. i would hire a sitter if you can or ask one of the neighbors if they can watch them for a little bit.
