This is the question that was posed to me today by a good friend of mine. Her ex boyfriend's new girlfriend took her daughter to get her ears pierced without asking anyone. Her daughter is only four years old. Both my friend and her ex boyfriend are pissed at the new girlfriend. Just wondering if this was actually illegal? Thanks!

It probably is. From what you said, ex this, boyfriend's girlfriend's whatever, it sounds as if a non parent brought a kid to be maimed without the parent's permission. She does not have the right to do that. So I'd say there actually is a crime there. However, in the scope of things, so what? It's not like this kid isnt going to end up with pierced ears anyway. So I'm not sure legal action is the right way to go. Stuff like this happens all the time, legal or not. My guess is the being pissed period will end long before the kid gets her first pair of diamond studs.

Yes, it was illegal.

Only the parents can authorize their child to get her ears pierced.

However...... no-one's going to do anything about it, I'm afraid.

If your state licenses ear piercers (Not all do) then you could file a complaint against the store with the licensing agency because they should have verified that the person approving the piercing was a parent.

When my son got a tattoo at 16 without parental consent I filed a complaint against the tattoo parlor, and they were fairly heavily fined.

This would depend on the laws of the state in question.

The place that actually did the piercing might be on the hook as well.

It's probably not criminal, and I don't see much coming from a civil suit (what would the damages be? How would you collect them from an airhead girl who'd do this?).

I think it is a state issue. In NJ, it would be illegal.

yes accually it is illegal she is not a guardian so she had no right your freind should put her in jail for endagering a minor

No, it's not illegal. As long as one parent consents, it's okay for a child to do almost anything. As long as they are of minimum age. 16 for tattoos I believe.
