Cause that happened to me last night, I figured it was a fake cop cause they can't do that right?

It wasn't even when the movie was on it was previews, and they didn't even show the part where it tells you to turn it off :p

Actually yes he could arrest you for disturbing the peace. Remembering that while you are in the theater you are on private property. The property owner/theater manager could have requested that the officer assist him in controlling the phone ringing issue. If such was the case then the officer was well within his rights to do what he did. Thing is you don't know if he was just a patron like yourself or was sitting there on behalf of the owner or if he was doing both.

Next time you go to that theater you might want to turn off your cell phone when the announcement which is actually a warning by the private property owner comes on the screen because they do have the right to evict you and yes even have you arrested for disturbing the peace.

What the cop did was not illegal, but he has no authority to keep you quite. The movie theater has that right, the only time the cop could get you out of the theater was if the theater staff asked you to leave and you refused. The theater could then ask the cop, since the theater has the right to kick you out.

It's not illegal to have a cell phone go off in a theater and he's just showing how almighty and powerful he is. Don't worry about his power trip he's a cop that's what they do. On the other hand you were being inconsiderate and oh so "All-American." Be courteous of other people and TURN OFF your cell phone when you're in the theater!

Probably not. But why did you have a cell phone on in the movie theatre anyway?
The commercial asking you to turn off cell phones is a reminder, not the point where you can keep them on until!
Why not be proactive and think about the enjoyment of the other movie goers and switch it to vibrate or better still off, before entering the theatre.

I don't think there's a statute that says your phone can't ring in a movie theater, so I don't see what a badge has to do with it. Was he maybe with the common courtesy police?

A cell ringing is not illegal and neither is flipping a cop.

flashed his badge bc your cell phone went off? did he threaten to arrest you? he cannot threaten you if there is no probable cause that you're in violation of some law. a cell phone going off in a theater rising to breach of peace is a big stretch. it could be abuse of process. and yes, he doesn't have to be 'on duty' to arrest you, but neither does a civilian under citizen's arrest laws in every state

haha some cops have some real ego issues... You should have called the cops with that cell phone and told them you have a stalker... or told him to hang on you have to answer this call.

He can flash his badge all he wants, but is it illegal for you to have your cell phone in the theater?
