First poster, you dont think sexual gratification at the expense of others is OK? Sorry, but you draw a distinction without a difference. People who get off on those things ALSO get off on rape scenes in mainstream movies. You are talking about a level of degree, not of content. A rape is a rape. Incest is incest. Some of the greatest literature in history speaks of both. You are offended by the presentation, not the content. Drawing conclusions to rationalize what has been determined to be protected speach by the US Supreme Court is much more dangerous than porn films. Porn films do not erode the US Constitution. Rationale like yours does.
Certainly, a rape or snuff film that ISNT acting would be illegal and unprotected speach. Why? Because the act being filmed is illegal. ACTING out a rape scene is not illegal. Neither is having sex on film. And in the "porn" industry, most people who appear to be having sex really are not in the first place. A snuff film is clearly illegal if it's real. But if it's acting, it's not. There is no difference between acting out a snuff scene for sexual gratification of others and Al Pacino shooting a hundred columbians with his little friend. Both depict murders. Neither of them IS murder. No laws are broken. The film is protected, regardless of sexual gratification.
The original question answers all questions. If the porn is depicting an act that is illegal...not in content but in reality...the film is illegal. If the film is filiming people ACTING OUT an illegal act, like a murder, the film is not. Porn films enjoy the same protections as mainstream films.

I'm not sure if beastiality depictions are illegal or not. If not, I think it should be. Illegalizing something that is strictly depraved, to me it isn't infringing on true freedoms.

Also, I am curious as to why porn would be "protected" as one poster brought up. If it is simply allowed, is one thing, but to protect it, puts it above other types of "speech". Protecting political speech makes a little more sense. Protecting what a porn consumer think as entertainment, seems oddly unneccesary.

There is (or at least has been) a lot of porn out there that depicts rape and incest, so that some people can get their kicks out of those criminal, predatory fantasies. I think this should probably be illegal. Even if the performers are really consenting and acting, I don't think it's a good thing.
Some people think that illegalizing this would infringe upon freedom of expression. I disagree. Unlike a movie depicting rape and telling a story, porn is for sexual gratification of its viewers, and I don't think it's good to encourage sexual gratification out of victimizing others, even if it's just an act.

The whole rape porn thing freaks me out too! I would ban any porn that involved a situation where one or more parties couldn't legally consent. IE, child porn, porn using animals, hidden cameras and stolen home movie porn.

I think porn involving animals is, and YES I definately think that child and animal porn should be illegal because neither children nor animals can consent to it and it is sick and exploits innocent people/creatures.

well, there is alot of nasty stuff on the internet, like dad having sex with step daughter,..or daughter for that matter mother having sex with her step son ..it just gets really really gross.
