Does she have a car seat for him though? Because if she did, then there shouldn't be a problem unless she's just being stubborn. If she doesn't, why not get one and just explain to her all the safety reasons of having one. If she cared enough, she'd do what's best for your son.

Maybe get some advice from your son's pediatrician. Get some literature from the doctors office on car seats, ages and weights. I hope it helps, I know they say that children should sit in a booster seat until they are 100 lbs. Of course, that's after the child grows out of their car seat. Best of luck!

If I were you I would try and talk to her one last time then I would contact my lawyer that did the divorce and tell him.Or you can contact a police officer if you see her driving with him out of a car seat, and they will pull her over and give her a ticket maybe that would get it in her thick head.Let her know you are not playing with her.That is your son's life she messing with.If she has a wreck he could be hurt bad.Ask her if she would like to go casket shopping see what she says.Best of luck hope you get the message to her that's a serious matter.Good Luck.

I hope she puts him into a seat belt or booster? You can check the law in your state to see what a child his age and size has to use for safety measures when in the car.
If she gets picked up by the police, she will get a ticket if she doesn't use proper restraints... and i hope she does!!

I would talk to her about using the carseat again, and if she brushes you off again, I would talk to your lawyer, and see about seeking custody of your children. There are carseat laws for a reason. Your son's safety is the most important thing.

Take her to court. This is a safety issue and she is putting your child's life at risk. If he refuses to use it and she is not wanting to force the issue she needs to take some parenting classes to learn how to get him to listen. She needs to not start the car until he is buckled in.

tell her children have to be in carseats/boosters legally till they are 4'9 and 80 lbs
she can get pulled over for this and charged with child endagerment
tell her if she thinks he's to big to be in a carseat to get a booster
we have a transitional seat that goes from 20-120lbs for our 3 yr old and she will be in it till she is 4'9 and 80lbs
