I'm 18 and she's 16. i live in NJ and she lives in IN... we had sexual relations over the phone and internet. the legal age of consent in both states is 16... her father is filing a report against me in IN for statutory rape... can I be tried and thrown in jail?

over the phone? that's a little funky to begin with, but if you are really worried about it, go see a lawyer.

Young man if you're 18 and don't know by now that sexual relations doesn't take place unless in person. Your game of sexual relations over the phone and internet is just that, a game.
Let the father file a report against you, it won't be statutory rape, it could be for something else. What you need to do now since both of you live in different states is to stop your games, you could end up in jail on different charges that you haven't thought of by using the internet lines.

being that your sexual relation occured over the phone and internet, rape is out of the question so your safe on that end. I'd need more details about what kind of "relations" your talking about to determine other charges.

not sure about IN law, but in NJ if your 18 and she's 16 your perfectly fine. A16 yr old (which she is) you can have consenting sex with another person up to 4 years older than them(20). Then once they are 18, free game. Based on NJ law, your safe, and i can only image IN has less strict laws(no offense those in IN)

i think its stupid since you are 18 and shes 16 (thats only 2 years apart) if you do get in trouble but if its on the phone and internet than i wouldnt worry

but just as some advice, get off the internet, stop talking to little girls online and get a real life... find a real girl buddy... than you'll see how pathetic one's life can be sometimes...

the stat rape may not stick, but the content of your Internet, especially photo's of sexual content may be questionable legal wise

he can't charge u with satuatory rape, you didn't have sex with her, well intercourse, i mean. and if consent is 16, wat's the prob?
these laws are getting on my nerves......if kids want to get disease and get preg, and sin by having premarital sex, let them, they'll learn.
