Alright, this is a totally random question that I need answered:

If you're driving drunk and you get into an accident with another vehicle and it is not your fault... what happens?
To that end,
What happens if you're drunk and the other driver's drunk as well?
(This, of course, assuming no one dies.)

There is no law against drinking, and driving. the charge is driving while impaired. It will be up to the Officer in regards to what citations will be issued. If impairment can be shown on both drivers, then both will be charged with DUI.

1. Regardless of the fault issue of the accident you would be criminally charged with DUI/DWI
2. In some states the other driver can charge that you driving impaired contributed to the accident and have some or all of the fault shifted to you for the accident.
If the other person is also drunk, they would also get charged with DUI/DWI.

A few years ago while attending college, I seen it happen and the ex Cedar City Utah Chief of Police can tell you that he was doing nothing wrong and got crashed into by a DUI driver....He was also arrested for being DUI and fired. So I believe they arrest all DUI people without question of whose fault the accident was.

There was justice that day! although his own department wouldnt sack him, the UHP did.

You can (and should be) arrested for drunk driving. If both drivers are drunk, both will be arrested. Re liability for the accident, the insurance companies will likely fight it out. You can be expected to be dropped from your insurance policy like a hot potato.

If either operator is impaired, then they would be arrested. Even if its not your fault, you will still be arrested if you are impaired. If injuries - even just a statement of my neck/back/arm/etc is sore - the operator will be charged you intoxicated use of motor vehicle causing injury.
