hi, as i am the only earner in my home me and my partner applied for council tax benefit and rent benefit and was granted it a few months back. one month i had to do three courses for work and was paid overtime for this . they have now stopped my benefit as they say i earn too much. ( they used that payslip to calculate my earnings) i have had a written letter from my employer stating that i was paid extra this particular month and it was not my wage normally. i also took down statements and payslips showing that since that month my pay had returned to its original low amount. they looked at out claim again and still said that the letter proved nothing and was a business expense that i had to meet.( made no sense to me either) we have now appealed but havent any reply for a month. any advice ? i'm not entitled to working tax credit as i'm 23 and have no kids. they also failed to note that since then my rent has increased.. grrrrrrrrr

ive already spoken to a person there with an appointment and was assured that it would be sorted. that was before the letter saying their decision hadnt been changed cos of the letter and the statements.

tell them you are illegal immigrant and you will get your rent and council tax payed for you.

In your local rent office , there will be a person trained to deal,personally with rent/council tax enquiries. Make an appointment and remember to take 3 months' pay slips , the letter from your employer and your last 2/3 months bank statements.

Hi they did this to me 5 yrs ago!
Every four weeks I ant an extra £30 for working a Saturday, so the council took £120 off me in housing benefit!!
They also didn't tell me or my landlord that they had stopped paying, I only found out when my landlord phoned me and asked why was I nearly £600 in arrears!
I made a complaint to the parliamentary ombudsman who said I could sue (if that's the right word) for maladministration.
I did......
I won my case and the council had to pay all my rent arrears!

Fortunately for me I was able to go back to work full time when my son started school, so was able to tell the council where they could stick their benefits, and no longer claim anything.

Fight them as hard as you possibly can and good luck.

You will need to take in the following month's payslip and ask for your claim to be re-assessed. I have had this problem due to arrears being paid months late when I wanted to claim hben/ctax so rather than the £400.00 pm I was supposed to get I actually received £800.00 they work out your income by averaging two months payslips. You may need to make a fresh claim and ask them to backdate it to the month where your pay had gone back down to the normal rate. As you have received that extra money they will say that you should use it to pay your rent.

Both benefits are calculated using weekly income figures so when your income was higher one month making you not entitled you should have reclaimed on the first week your wage went back down

A letter from an employer means nothing in benefit law....you need to provide weekly wage slips
