My friend is an immigrant, she has been married for 2 years to a US citizen. Her temporary green card will expire in 2009 February. They getting a divorce probably the next couple weeks.. :(
Can she apply for the permanent card after the divorce?

She can apply to have the conditions removed of her green card alone but she will have to prove that the marriage was entered in good faith.

"If your marriage was terminated other than by the death of your spouse, you must submit the following:

* USCIS Form I-751 (Petition to Remove the Conditions on Residence)
* Copy of USCIS Form I-551 (Permanent Resident Card)
* Evidence that you entered in the marriage in good faith, and not to evade the immigration laws of the United States. Examples of such evidence includes, but is not limited to:
o Leases showing that you and your spouse lived in the same place
o Documents that prove that you and your spouse owned property together
o Birth certificates of your children
o Copy of your divorce or annulment decree
o Evidence that you were not at fault in failing to file the petition on time, if applicable.

Yes she can reapply,Depending on why she is getting the divorce there is different programs to help her extend her green card.Tell her to don't delay and have all the evidence with her on her divorce

Sure, she can apply. If it is granted will depend on her ability to support herself etc.

I thought marrying a Citizen makes her a citizen too...y would she wana apply for one now ?
Pls post your message in a immigration FAQ website to get a accurate answer, she wouldn't want to take chances.
