when they took my rights way they said they sent letters and served me for court but i never recieved them, when i went to the court house to check my file they told me that some were returned and they only tried looking for me in one address do i have a chance on getting her back now since i was not told that my rights were terminated?

More than likely not. States do not terminate rights lightly and it takes a very long time...of course this depends on your state but like someone else stated...you knew that your child was in foster care. It was YOUR responsibility to keep in contact with the state, not the other way around. In Virginia when a child is removed from a parent they have ONE YEAR to get their lives together and correct whatever resulted in the removal. THEN the process of termination begins and that takes 6 months to a year. I can't imagine that other states are that much different...if anything they probably move slower, not faster. You had ample time to find out what needed to be fixed and to fix it....All of that being said, it's not very common for a parent to regain rights once they are terminated. Your life would have to be a complete 180 from where it was when your rights were terminated for you to even begin to DREAM of it happening.

No you cannot get her back, nor should you. Listen, termination doesn't take 3 days, or two weeks, or a few months. It takes a VERY long time. You knew your child was in foster care, you knew you had to do certain things to get her back. You obviously weren't communicating with the state and purposely didn't do what you needed to do for your child. Everyone is allowed visitation and court dates. You purposely failed to do any of that. Shame on you. Let it go. Your child is now her child and bonded and attached, and thank goodness you have no rights whatsoever. You need to get your act together and your priorties straight.

You already know your rights were terminated. It is in your case file. It is not the court's fault that either you are moving around or the court did not have the current address.

The only way to get your parental rights back is to prove to them that you are stable and capable of supporting and rearing your child in a good home. You are staring at getting an attorney.

Honestly ask yourself if you are a better home for this baby then the Aunt.... if so, then get a lawyer.

If the baby will have a great life, then the best gift you can give...is to let him/her go. Keep in touch always... and know that you did the right thing. Be brave, is someone helping and supporting you emotionally ? I wish you luck in whatever happens.
