My wife signed up for reunion.com and she used my old check from a bank i havent used in months knowing theres no money in it and that shes not on the acct? Would that be considered check fraud ??

is the key phrase.
Technically it IS fraud since She KNEW there was no money to cover the check. A lot of states assume permission to use an account is given to a spouse verbally, and it would be tough to prove it wasn't (in most states ALL MONEY is considered a "common asset" in a marriage. Regardless of whose account it's IN it would be split in a divorce).

The check will return to reunion.com as "ACCOUNT CLOSED". If it's a small enough amount they may just cancel your account & be done with it. They might contact YOU trying to collect on the check and any returned check fees, but if You pay them it all goes away.
It would have to be a pretty BIG amount before they would bother involving the legal dept, contacting the police (or the FBI if they are based in another state), getting a judgement against you, etc... Fraud charges are a REAL HASSLE.

Unfortunately if she went on line and did an electrnoic check she must have had your user name and password, therefore how will you prove to the bank that it was her not you who access the account?
The bank will always say that they have record of YOU signing on line. You will have a hard case to prove to the bank, howver you can alwways sue your own wife, and try to get covery from her not the bank.

Are you wanting to charge your wife or something? Did you know she was doing it? Sounds like you want a way to punish her or something??? Get a lawyer...cause your gonna need one if you charge her...shes gonna leave you. Especially if you knew what she was doing and you gave her permission to use the checks. Who pays the bills in the house? YOU OR HER????

If you wanted to pursue it, I imagine you could charge her. But if you do, make sure you have enough money in your checking account to sign up for the dating sites, because you will be single!

It probably is, but I would think she can wiggle out of it pretty easily. If you were seperated or getting a divorce, it would be bad for her. Otherwise, she will just claim you said it was all right and who can dispute her.
