I don't think it is illegal, as long as they are over 21. I don't think most places that employ bartenders would appreciate it if they did. I don't have any sources. I do know that every once and awhile the friends that I have that bartend, will take shots with there customers.

Can't speak to California, but in Ohio the bar I worked at let us drink. Here in Illinois the bar down the street from my place has a policy that their employees can't even drink (at the bar) on their days off.

Its not illegal but probably not what their employers would like to see happen. If you are old enough to drink, you can drink in a bar but if the bartender doesnt pay for his drinks its called stealing.

In my opinion yes it should be illegal for a bartender to drink on duty no matter what state they are in not just in California.

no, it is not. they have to abide by the same rules as if it were federal law in OSHA. Most or all restaurant forbid drinking on the premise, insurance issues.
