i bought this here second lap top with windows basic and it really sucks i still have some warranty left but future shop wont give me back my $$$$$$

The OS you have been handed is the OEM edition. You can't get your money back for the OEM without legal help. Then the refund (less than $50) will be worth far less that what you will spend on legal fees.
This ofcourse seems like a scam to milk the public. So unless someone initiates a class-action lawsuit, OEM refunds are difficult.
- You can either grin and bear it
- or you can cheat BillG out of his dues by installing pirated Vista Premium
- or you can switch to an alternate OS like Ubuntu Linux

Bill doesn't do refunds and Future Shop would have, if you had returned the PC within 2 weeks of your purchase.
If the real problem is Vista, buy the XP Recovery disks from your laptop manufacturer.
DO NOT try to use a Store-bought or illegal XP CD.
