To the best of my knowledge per the seler, the ATV was never titled. Many people do not title ATV's because most stateds do not rewquire titling. He did show me a Certificate of Origin (CO) from the dealer that he purchased it from. The CO is filled out properly and the area for leins is not filled out. Does that mean there are no leins against it?

I would have the tiltle checked out,maybe the dmv can help

The answers were not quite right. Having the actual title is good. But in some states a lien can be placed against certain types of collateral without the lien holder having or noting the title.
Check with the state DMV. Also some states have free or small fees for lein checks.

All you have to do is have the buyer produce the title. You need to inspect it, front and back to look for a lien holder stamp. If the title is clean you are ok.

P.S if you are unsure just ask the seller to photo copy the front and back of the title and take it to the DMV

However if you notice a lien stamp, but the seller insists that it is paid off. They will have to produce a letter of lien release stating that the lien has been satisfied.

It is usually no problem to transfer a title as long as you have that letter but if you want to be safe request that the seller produce a clean title before you complete the transaction.
This is no big deal for them, normally 20 minutes and $10 later he's done.

If they give you any hassle about it somthing is probably up!
