i am 31 and on disability for multiple sclerosis. my 'girlfriend' is in the process of getting divorced, she is legally seperated but not fully divorced. she is pregnant with my child (yes, it's mine) she is still covered by her 'ex' husbands medical coverage until the divorce is finalized. if the slow wheels of the justice system are still turing when the baby is born and she is not divorced yet will i be able to get coverage through medicare for my child? i need detail....

The child is legally her husband's child, not yours. Did you know that? Unless you marry before the baby is born, it will have his name on the birth certificate by law and he ends up financially responsible EVEN IF the divorce is final. This is true in most states. SO, no, you can't get Medicare coverage because it is his child until a court says otherwise.

To further answer your question, if you do legally become the child's father (after court), only your dependent, the child, is covered by Medicare. That means the birth is not covered, your GF is not your dependent, but nursery care would be. Now, this all assumes that you worked your required quarters and have regular Social Security Disability. If you have SSI, you may not be eligible for dependent coverage. At that point, it likely becomes a Medicaid issue.

I think she does in fact have to be fully divorced first. You can always call and ask the medicare company though.

The child might be elgible for medicade, not medicare. Look up your state's requirements.

You will but I really think she needs to be divorced first in order for it to take effect.
